Reader’s Question:

I live in Ohio. I just want to know If I damage my friend’s car, will his insurance cover it or mine? Thanks.

Joel

Thank you for asking Joel.

The Auto Insurance Buyer’s Guide on the Ohio Department of Insurance website states that the individual who are typically covered on an insurance policy is you, family members who live with you (that you have listed on your policy) and in general any licensed driver that you permit to operate your car unless your policy rules out this provision.

Normally it is the car owner’s insurance that would be primary and the driver’s auto insurance would be secondary. This means that his car insurance would pay on the damages first. If his insurance policy did not cover all of the damages then your insurance could be used for excess cost for the damages.

Goodluck!

Reader’s Question:

I am required to carry an sr22 but I just want to know if this is enough to get a car loan? Please help. I live in Ohio.

Rico

Thank you for asking Rico.

SR-22 certificate is the insurance required for an Ohio state liability . It is not physical damage coverages of collision and comprehensive that most financial institutes will require you to have on a car if you have a loan or lease to pay on whether the car is a new used one or brand new one.

You can contact your insurance agent about carrying the required insurance for the SR-22 or the financial responsibility certificate. You may also ask them about the physical damages coverages that would be required by a lien holder when you purchase a car. You should be able to get both types of coverages to maintain what the state and lien holder will require of you.

If you cannot get both types of coverages with your current insurance provider you may shop around online for other insurance companies that provide it.

Goodluck!

Reader’s Question:

I just received a ticket for driving without a license and I just want to know what the penalties will be. Im a minor and I live in Ohio. Thanks.

Albert

Thank you for asking Albert.

Chapter 4507 of the Ohio Revised Code (ORC) which includes the Driver’s License Law for OH, states that no individual shall allow the operation of a motor vehicle upon any public or private property used by the public for purposes of vehicular travel or parking knowing the operator does not have a valid driver’s license issued to the operator by the registrar of motor vehicles.

If you get caught driving without a license you are guilty of a misdemeanor of the first degree. Driving without ever being licensed may result to being fined of up to $1000 and jail time of up to 180 days. Since you are a minor there will likely a delay in you being able to receive an OH learner’s permit or license.

To get more information about your conviction and the penalties you may receive, you may call the court listed on your ticket and also contact the Bureau of Motor Vehicles (BMV).

Goodluck!

Reader’s Question:

I received a speeding ticket going over 17 mph? Is it going to be reported back to my home state in Michigan?

John

Thank you for asking John.

Ohio is part of the Drivers License Compact. On the other hand, Michigan is not part of this multiple state agreement that requires member states to exchange information of a person moving violations they receive out of state.

Even though Michigan is not part of this DLC to share traffic violation information between state courts and DMVs, they still have their own agreements to forward this information to other states and also get informed if a licensed motorist in Michigan is cited of a ticket out of state.

According to the Michigan Department of the State, if an out of state infraction corresponds to a offense listed in Michigan law, then the moving infraction will be recorded to your driving history and assigns points as required by the MI Vehicle Code.

It seems that not only will the speeding ticket that you received in Ohio will be placed on your Michigan driver’s license but also be assigned Michigan DMV points. For 16 mph or more over the posted speed limit MI assesses 4 points.

Reader’s Question:

I just wanna know how I will be able to know the points in my drivers license. I live in Ohio.

Patty

Thank you for asking Patty.

You may be able to get information of the total points on your Ohio Driver’s License by contacting the Bureau of Motor Vehicles (BMV) and getting a copy of your driving record/abstract. This contains an the person’s three-year record of violations and accidents.

The BMV site states that you may be able to get your driving record by mail or in person.

An individual maybe able to obtain a prior 3-year driving record of violations and accidents regarding any person by mail. It is important to provide the full name, address, date of birth, social security number, and driver license number on the form.

There is a fee of $2.00 for each driving record requested made by mail. It usually takes 14-21 days to process the requests by the BMV.

By visiting a local deputy registrar license agency, you also may also acquire your driver’s license information . For each driving record request a fee of $5.50 should be paid.

Reader’s Question:

I got a speeding ticket in Ohio and I just want to know how many points it will take off and if my license will be suspended? I live in Indiana.

Gene

Thank you for asking Gene.

Indiana, your home state, and Ohio ,where you received your ticket, are both members of the Drivers License Compact. This means that the Ohio BMV will share back to Indiana’s BMV information regarding your traffic offense of this speeding ticket.

In Ohio it is a 4 point offense for driving 30 mph or more over the speed limit. In Indiana on the other hand, it is a 6 point offense speeding 25 mph in excess of the posted speed limit.

Since you are licensed in Indiana, it looks like you would receive the assessment of points in Indiana. According to the Indiana BMV moving infraction convictions, which IN has a corresponding violation, the violation will be put on your driving record along with the allotted points.

To get more information on other penalties that Ohio might give you for getting speeding ticket, contact the Ohio Bureau of Motor Vehicles and/or the court entity listed on the ticket that you received.

Goodluck!

Reader’s Question:

I got a speeding ticket in the state of Ohio. Will this be transferred to my home state KY? Is there a way to remove it? Can I enroll in a traffic school? Please help.

Jana

Thank you for asking Jana.

Kentucky and Ohio are both part of the Drivers License Compact. This means that Ohio will share your speeding ticket to Kentucky therefore it will likely show up on your KY driving record. Although Kentucky does not assess points for out of state speeding tickets, it does for other types of tickets.

Kentucky’s defensive or traffic school can be referred to by the court system and since your ticket was in OH and not KY then I dont think that you could do traffic school. The speeding ticket that you received in Ohio could affect your insurance rates in Kentucky when it shows up on your record.

Insurance providers differ on their rating system so you may contact your insurers to find out how this ticket can affect your premiums. So if you do not want to just pay the ticket and remain on your driving record you could contact an Ohio lawyer to see what options you have.

Reader’s Question:

I just want to know if the ticket I received in Kentucky will go to my driving record in Cincinnati OH?

Mike.

Thank you for asking Mike.

Ohio and Kentucky are both members of the Drivers License Compact. This agreement requires all member states to share all traffic infractions received by a motorist back to their home state where the person is licensed. So the Kentucky courts or Cabinet of Transportation will notify the Ohio Bureau of Motor Vehicles about your KY ticket.

We have read in the past that Ohio does not assign points for out of state tickets, but will put the infraction or moving violations on your driving record. Ohio has changed their offense points system in the last few years so you may check with the Ohio Bureau of Motor Vehicles (BMV) to get more information on how out-of-state traffic violation convictions are now dealt with.

Reader’s Question:

I received a ticket for speeding in the state of PA and I just want to know if it is true that Ohio does not assess points on out of state violation. Thank you.

Cassandra

Thank you for asking Cassandra.

Ohio and Pennsylvania are both part of the Driver License Compact (DLC). This means that they do share information between their licensing agencies. For Ohio this is the Bureau of Motor Vehicles (BMV).

It was said that Ohio does not assign points for out-of-state traffic infractions but in the last few years Ohio has changed the state’s points system so I would suggest that you check with the BMV to get information and make sure if your speeding ticket you got from PA will be assigned points or only be noted on your driving record in Ohio without points assigned to it.

If points are assessed for the PA speeding ticket under the points system in Ohio would result in 4 points, 2 points or no points. This depends on what the speed limit that was posted and the number of exceeding mph.

Reader’s Question:

I just want to know for how many years does a DUI remain on my record. I live in Ohio.

Tom

Thank you for asking Tom.

If you get convicted for the first time of a DUI in Ohio penalties available will be:

* Administrative License Suspension (ALS) for a prohibited BAC;
* ALS for test refusal = one year license suspension;
* Jail - Minimum of three consecutive days or 3-day driver intervention program;
* Fine - Minimum $200 and not more than $1,000;
* Court License Suspension - 6 months to 3 years.

The Ohio Bureau of Motor Vehicles (BMV) states that there is no section of the Ohio Revised Code (ORC) that states infractions ever come off of a driver record. It goes on to say that an administrative decision is in effect that permits for Driver Abstracts to only reflect the last three years driver record activity.

So it looks like a DUI infraction will stay on your OH driving record indefinitely but you can verify with the BMV to find out to make sure.

Goodluck!
